House plenary session on the impeachment complaint

Some issues debated but not settled -

Whether or not the complaint was sufficient in form on the basis of its recital of facts constituting the offenses charged and determinative of the jurisdiction of the committee.

Impeachment process is admittedly a political process but has been highly politicized reducing the process to a “democratic” numbers game. Members of both the majority and minority (which both have had the experience of filing impachment complaints and being dismissed due to this “numbers game”) seem to agree on the need to review the rules of impeachment.

Whether or not the report of the Committee on Justice (which earlier dismissed the complaint due to insufficiency in substance) should be approved in principle as parliamentary practice. Although approval in principle, fiat accompli, is practiced in parliamentary procedure, there is question whether or not this should also be so in impeachment proceedings.

There also seem to be a number of anomalies in the implementation of Committee rules.

Impeachment process used in the Quirino administration is not applicable to the Arroyo administration because every congress adopts its own rules on impeachment proceedings.
